Acceptance of Terms
By downloading, accessing, or using the Mashrouk mobile application, website, or services, you:
- Acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.
- Confirm that you comply with all eligibility requirements outlined herein.
If you do not agree to these Terms, you must immediately cease using the Service.
Eligibility
The Service is available only to individuals who:
- Are at least 18 years old.
- Possess the legal capacity to enter into contracts under Saudi Arabian law.
- Have a valid Saudi national ID/Iqama (for riders/drivers as applicable).
Modifications
Mashrouk reserves the right to modify these Terms at any time. We will notify users of material changes via:
- In-app notifications.
- Email (if registered).
- A prominent notice on our website.
Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Jurisdiction & Language
These Terms are governed by the laws of the Kingdom of Saudi Arabia.
- Any disputes shall be resolved exclusively in the courts of Riyadh.
User Responsibility
You are solely responsible for:
- Maintaining the confidentiality of your account information
- All activities conducted through your account
- Compliance with all Saudi laws and regulations while using the Service
Ride Booking & Payment
Fares are calculated based on distance/time/dynamic pricing
- Accepted payment methods: Cash, credit cards, POS terminals, Apple Pay
- Cancellation policy: Free if canceled within 2 minutes; fee of 10 SAR thereafter
Liability & Safety for Independent Drivers
Drivers are independent contractors; Mashrouk is not liable for accidents/disputes
- Users must comply with Saudi laws (no drugs, weapons, or harassment)
Liability & Safety for Mashrouk Drivers
Mashrouk's Responsibilities:
- Ensures all drivers have valid licenses under TGA regulations
- Conducts background checks, driver training, and vehicle inspections
- Maintains commercial insurance covering vehicle accidents
Safety Requirements
For Passengers:
- Wear seatbelts (in accordance with Saudi traffic regulations)
- No smoking, alcohol, or prohibited items (weapons, drugs)
- Treat drivers with respect; misconduct or damage may result in account closure and legal action
For Drivers:
- Comply with traffic laws and safety procedures
- Report any accidents to Mashrouk immediately
Liability Limits
Mashrouk is not liable for:
- Delays or cancellations due to force majeure (storms, road closures)
- User violations of safety procedures (injuries from not wearing seatbelts)
- Loss of personal belongings in vehicles
Maximum Liability:
- Mashrouk's liability for employed drivers is limited to direct damages under labor and insurance laws
- Claims must be submitted within 24 hours of the incident
Accident Procedures
In case of accidents:
- Driver calls emergency services (993/911) if necessary
- Report to Mashrouk via app or mashrouk.support@amk.com.sa within 24 hours
- Submit police report (required for insurance claims)
Service Termination
Mashrouk may suspend accounts for terms violations (fraud, safety risks).
Governing Law
Disputes shall be resolved under Saudi law, in the courts of Riyadh
